Terms of claim for compensation
(1)如對所裝貨物持有異議或要求索賠,必須于貨物到目的地后十五天內提出,否則概不受理。
Claim, if any must be made (laid,put in) within 15 days after the arrival of the goods at the destination, otherwise, none will be considered.
(2)如對所交之貨有異議,索賠時須提供充分證明。
In case of a claim for compensation in respect of this consignment, it should be supported by adequare documents (sufficient evidence).
(3) 如對貨物或在執(zhí)行合同中發(fā)生爭執(zhí),應友好協商解決不訴諸于法律。
Disputes, if arise, in connection with the shipment or with the execution of the contract shall be settled amicably through negotiation without resorting to legal proceedings.
(4)如對方協商不能解決爭執(zhí)時可提交仲裁。
Disputes may be submitted for arbitration in case no settlement can be reached through negotiation between both parties.
(5)超過供應者責任范圍的索賠案件概不受理。
Claim within the resposibility of any parties other than the supplier will not be accepted by us.
(6)如需訴諸仲裁,則應提交中國國際貿易促進委員會對外貿易仲裁委員會進行。該委員會的裁決將作為最后依據對雙方都有約束。
Arbitration, if neccessary, must be conducted by the Foreign Trade Arbitration Commission of the China Council for the Promotion of International Trade, Beijing whose decision shall be accepted as final and binding upon both parties.
(7)有關保險及/或運輸方面的索賠,應分別提交保險公司和/或運輸公司辦理。
Claim (claim for compensation) concerning insurance and /or transportation should be referred to the insurance company and /or the shipping company.
(8)如因人力不可抗拒的事故,以致延期交貨或無法交貨時,我們不負任何責任。
In the event of force majeure or any other contingencies beyond our control, we shall not be held responsible for the late delivery or nondelivery of the goods.
